Welcome to use the "Moonlit Novel" product and related services (hereinafter referred to as the "Service"). Before starting to use the Service, please carefully read and fully understand all the terms of this Agreement, especially the clauses involving liability exemption or limitation, applicable law and dispute resolution (such clauses have been highlighted in bold). Your registration, login and use of the Service shall be deemed your acceptance of this Agreement, indicating that you agree to be bound by all the terms hereof. This Agreement shall constitute a legally binding formal document between you and "Moonlit Novel".

If, in accordance with the relevant laws and regulations of the People’s Republic of China ("PRC"), you do not have the corresponding civil capacity to engage in your actions, please read this Agreement under the guidance and accompaniment of your guardian, and obtain your guardian’s explicit consent before using the Service. If you do not have the corresponding civil capacity, you and your guardian shall bear all consequences arising therefrom in accordance with legal provisions.

Please ensure that you have the legal right to sign and agree to be bound by this Agreement in accordance with the laws of the People’s Republic of China (for the purpose of this Agreement, including administrative regulations, departmental rules and normative documents, the same below) and the laws of your place of residence or the laws you voluntarily submit to (hereinafter collectively referred to as the "Laws"). If you sign this Agreement on behalf of your employer or unit, please ensure that you have obtained sufficient authorization to sign.

1.Service Content

1.1The Service refers to various functions and services provided to you through Moonlit Novel, including reading novels, search and query. We reserve the right to adjust the Service content according to actual circumstances and will promptly issue corresponding notices to users.

1.2You understand and agree that we only provide technical services related to Moonlit Novel. In addition, devices related to network services (such as personal computers, mobile phones and other devices required to access the Internet or mobile networks) and corresponding fees (such as network access fees, communication fees, etc.) shall be borne by you.

2.Account Registration and Login

2.1You may register a Moonlit Novel account by entering your email address, or through authorized login via third-party accounts such as Apple and Google.

2.2When registering an account or logging in with authorization, please fill in or submit relevant data and information in accordance with the prompts of Moonlit Novel, and ensure the authenticity, accuracy and completeness of the provided identity and information; if the relevant information changes, please update it in a timely manner. The registration information such as the account name and avatar you use shall not contain illegal or inappropriate content. If Moonlit Novel finds such cases after review, it will refuse registration; if it is found after registration that the user’s account avatar and other registration information contain illegal or inappropriate content, Moonlit Novel has the right to take measures such as ordering correction within a time limit, suspending use, and canceling the account without prior notice. After successful registration, you shall take reasonable measures to maintain the security of your account, and be responsible for all activities and events conducted after logging in through the account, and bear the direct or indirect legal liabilities arising therefrom.

2.3You understand and agree that when you successfully register and log in to Moonlit Novel using your Email account or mobile phone number, we cannot fully identify the illegal or unauthorized use of the account. Therefore, Moonlit Novel shall not be liable for any actions of logging in and using the relevant services of Moonlit Novel through your account. You agree and undertake:

2.3.1If you find that your account has been used without authorization or other security issues occur, you will immediately and effectively notify Moonlit Novel; at the same time, you need to understand that Moonlit Novel needs a reasonable time to take action on your request, and such actions may not be able to avoid or prevent the occurrence or expansion of infringement consequences;

2.3.2For losses and consequences caused by your active disclosure of account information, being attacked or defrauded by others, you shall claim compensation from the infringer through judicial, administrative and other channels.

2.4Moonlit Novel has the right to refuse or restrict the use of the account, or cancel the account, and terminate this Agreement at the same time, if it suspects that the account is being improperly used in its sole discretion.

2.5When registering and using the account, you shall commit to complying with the seven basic principles including laws and regulations, the socialist system, national interests, legitimate rights and interests of citizens, public order, social morality and information authenticity. You shall not have illegal or inappropriate content in the account registration information, and shall ensure that the following circumstances do not occur:

2.5.1Violating the provisions of the Constitution or laws and regulations;

2.5.2Endangering national security, leaking state secrets, subverting state power, or undermining national unity;

2.5.3Damaging national honor and interests, or damaging public interests;

2.5.4Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

2.5.5Undermining national religious policies, or promoting cults and feudal superstition;

2.5.6Spreading rumors, disturbing social order, or undermining social stability;

2.5.7Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crimes;

2.5.8Insulting or defaming others, or infringing upon the legitimate rights and interests of others;

2.5.9Containing other content prohibited by laws and administrative regulations.

2.6You fully understand and agree that you must be responsible for all actions under your registered account, make your own judgments on the content in the Service, and bear all risks arising from the use of the content, including risks arising from relying on the correctness, completeness or usefulness of the content.

3.User Usage Norms

3.1You agree to comply with laws and the provisions of this Agreement when using Moonlit Novel, use the Service in good faith, and ensure that:

3.1.1You will not use Moonlit Novel to engage in illegal activities, or infringe upon the rights or damage the interests of others;

3.1.2You will not obtain or use the information of other users of Moonlit Novel in an illegal manner;

3.1.3You will not attack, destroy or alter part or all of Moonlit Novel through technical means, or interfere with its normal operation;

3.1.4You will not obtain or use any code, technology or commercial information of Moonlit Novel in an illegal manner;

3.1.5You will not conduct reverse engineering, reverse compilation, reverse assembly or modification of the programs running on Moonlit Novel;

3.1.6Without permission, you will not use the name of Moonlit Novel, company name, trademark, commercial logo, applet layout or content, or other information or materials for which we have intellectual property rights or other rights;

3.1.7You will not infringe upon our trademark rights, copyrights, patent rights, other intellectual property rights or other legitimate rights and interests, nor derogate our commercial reputation in any way;

3.1.8You will not use Moonlit Novel for commercial purposes, nor exploit, copy, reproduce, sell, investigate, advertise any part or all of Moonlit Novel for commercial purposes, nor use Moonlit Novel for any other commercial purposes or commercial activities, unless Moonlit Novel signs a separate agreement with you or designates specific commercial services available to you;

3.1.9You will not use Moonlit Novel to engage in other activities that violate laws and regulations or public order and good morals.

If you violate the above agreements, Moonlit Novel may report your records of violating laws or infringing upon the rights and interests of third parties to the relevant administrative authorities or judicial organs.

3.2You shall ensure that the information uploaded to Moonlit Novel does not contain the following content:

3.2.1Violating the prohibitive provisions of national laws and regulations;

3.2.2Involving political propaganda, feudal superstition, obscenity, pornography, gambling, violence, terror or abetting crimes;

3.2.3Being fraudulent, false, inaccurate or misleading;

3.2.4Infringing upon the intellectual property rights of others or involving the trade secrets and other proprietary rights of third parties;

3.2.5Insulting, defaming, threatening, involving the privacy of others or otherwise infringing upon the legitimate rights and interests of others;

3.2.6Containing viruses, Trojan horses, crawlers and other malicious software or program codes that may damage, tamper with, delete, affect the normal operation of any system of Moonlit Novel or obtain the data and personal information of Moonlit Novel and other users without authorization;

3.2.7Other content that violates social public interests or public morality, or is not suitable for uploading in accordance with the relevant rules of Moonlit Novel.

3.3You understand and agree that you must obtain all services through legitimate and legal channels, and services provided through other non-official channels are not protected by us.

4.User-Generated Content

4.1All information generated by you in any form on Moonlit Novel shall comply with national laws, regulations and relevant provisions, conform to social public order and good morals, and shall not infringe upon the legitimate rights and interests of any third party. If we find that the content generated by you through Moonlit Novel does not comply with the aforementioned provisions, we have the right to take corresponding measures.

5.Intellectual Property Rights

5.1We shall have corresponding rights to the materials contained in the Moonlit Novel Service and software that are protected by intellectual property laws or other laws. The intellectual property rights of the overall content of Moonlit Novel (including but not limited to design drawings, product and service names, etc.) belong to us. Without prior legal written authorization, no one may copy or use them for other purposes without permission.

5.2Moonlit Novel shall have intellectual property rights to its proprietary content, original content and exclusive or sole content obtained through authorization. Without the written permission of Moonlit Novel, no unit or individual may copy, reprint, disseminate or provide listening services privately, or engage in other acts of infringing upon the intellectual property rights of Moonlit Novel. Otherwise, they shall bear corresponding legal liabilities.

5.3You understand and agree that unless you have another agreement with us or otherwise stipulated by law, the rights to the content uploaded/provided by you when using Moonlit Novel and related services shall belong to you or the obligee who legally enjoys the intellectual property rights. Your use of the Service will not affect the ownership of the aforementioned content rights.

5.4The rights to the content generated based on the Service shall be maintained by you and used after your independent judgment. If any problems arise due to the creation or use of the generated content, you shall handle them yourself. We shall not be liable for any losses caused thereby, and if you cause losses to us due to this, we have the right to claim compensation from you.

5.5We respect the legitimate rights and interests of intellectual property rights and other obligees, and actively take effective measures to protect the legitimate rights and interests such as the intellectual property rights of others. If an obligee such as an intellectual property right holder believes that the content displayed by users on this platform (including the knowledge base content shared/published by users) infringes upon their legitimate rights and interests, they may report, complain, feedback opinions to us, and provide corresponding supporting materials. We will take handling measures in accordance with the law.

6.Privacy Protection

6.1Moonlit Novel may require you to fill in personal information that can identify the user’s identity to provide you with a better user experience. "Personal information" includes but is not limited to the mobile phone number you use.

6.2Moonlit Novel undertakes to collect, use, store and manage the personal information provided by you during registration or use of Moonlit Novel in accordance with the methods stipulated by laws and regulations and the methods that ensure your safe and stable use of Moonlit Novel, and will not disclose your personal information in an illegal manner.

6.3You agree that Moonlit Novel may collect, use, store, share and transfer user personal information in accordance with the "Privacy Policy". For specific terms, please refer to the "Privacy Policy".

7.Disclaimer

7.1Moonlit Novel will make every effort to ensure its stable operation. You understand and agree that due to legal, policy, technical, economic, management and other reasons, Moonlit Novel shall not be liable to you for the following circumstances:

7.1.1The Service is unavailable, interrupted or fails to fully meet the user’s usage requirements;

7.1.2The Service is interfered with, fails to operate in a timely, safe and reliable manner, or has any errors;

7.1.3Any products, services or other materials obtained through the Service do not meet your expectations;

7.1.4User data is used or modified without authorization.

7.2To achieve the purpose of your use of goods or services, Moonlit Novel will retain your personal information for the shortest period necessary, unless otherwise stipulated by laws and regulations. If you cancel your Moonlit Novel account, or the services provided by Moonlit Novel are terminated or canceled, Moonlit Novel may permanently delete the user data from the server. Except as explicitly stipulated by law, Moonlit Novel cannot return or provide any data to the user under such circumstances.

7.3You shall comply with national laws, regulations and policy provisions when using the Service of Moonlit Novel, and bear the consequences of your actions arising from the use of the Service of Moonlit Novel.

7.4You understand and agree that the services, products or content provided by Moonlit Novel to you may be changed, suspended, interrupted or terminated due to changes in laws and regulations, regulatory policies, requests from obligees or copyright owners, product plans, operational conditions and other reasons, including but not limited to the permanent or temporary removal, suspension of services, products or content. The aforementioned measures shall take effect immediately upon implementation.

8.Notices

8.1Notices sent by Moonlit Novel to you may be delivered through short messages, phone calls, or announcements in prominent positions within the applet or web terminal. Moonlit Novel will deliver the message to you through one of the above methods to inform you of modifications to the service terms, service changes or other important matters.

9.Liability for Breach of Contract

9.1If Moonlit Novel causes losses to you due to violating relevant laws, regulations or any terms under this Agreement, Moonlit Novel shall bear the corresponding liability for compensation.

9.2You agree to protect and safeguard the legitimate rights and interests of Moonlit Novel and other users. If you cause losses to Moonlit Novel or any other third party due to violating relevant laws, regulations or any terms under this Agreement, you agree to bear the liability for compensation arising therefrom.

10.Applicable Law

10.1When using Moonlit Novel, you shall comply with the laws of the People’s Republic of China ("PRC"), the laws of your place of residence and the laws you voluntarily or shall submit to. This Agreement shall be interpreted and performed in accordance with the laws of the People’s Republic of China.

11.Dispute Resolution

11.1The place of signing this Agreement is Chaoyang District, Beijing, PRC.

11.2The effectiveness, performance, interpretation and dispute resolution of this Agreement shall all be governed by the laws of PRC. All disputes, claims or other matters arising from or in connection with your use of Moonlit Novel shall be governed by the laws of PRC.

11.3All disputes arising between you and Moonlit Novel shall be resolved through friendly negotiation; if the negotiation fails, either party may file a lawsuit with the people’s court with jurisdiction over the defendant’s domicile.

11.4This clause shall be deemed separable. If any clause of this Agreement is deemed revoked, invalid or unenforceable, it shall not affect the legal effect of the other clauses of this Agreement.

12.Miscellaneous

12.1Moonlit Novel may from time to time issue relevant agreements to users, which will serve as supplements or modifications to this Agreement and form part of this Agreement. Please pay attention to and read the relevant agreements in a timely manner.

12.2If any clause of this Agreement is deemed revoked, invalid or unenforceable, such clause shall be deemed separable and shall not affect the validity and enforceability of the remaining clauses of this Agreement.
